View Full Version : Falcon Foto suing Guerilla Traffic

Well, two industry veterans are not getting along.

Falcon Foto served papers to Guerilla Traffic on the show floor at Internext. Here's some of the info:

LAS VEGAS — In a lawsuit served on the showroom floor at Internext, Seattle-based Falcon Foto has said it is suing Amsterdam-based Centurion Limited, which owns and operates the affiliate programs Guerrilla Traffic and Porn Profit, for copyright infringement.

The suit, which was filed Jan. 16 in a Seattle federal court, charges that Guerilla Traffic and Porn Profit committed more than 700 separate instances of copyright infringement on more than 300 web pages.

“Falcon Foto will continue to vigorously protect its intellectual property and its legitimate licensees,” company President Jason Tucker said. “This is only the beginning of our filings for 2007.”

I just hope that guerilla webmasters don't over-react without thinking on this and jump ship. Keep watch on it as we still haven't heard the other side of the story yet. Being served doesn't mean your company is falling apart.

Strong statement here:
“Centurion remains liable under the law for $150,000 per image, plus attorneys fees and court costs,” Apgood said. “The statutory damages in this case could be in excess of $100 million. Some say that members of the adult industry should not sue each other. Wrong. They should not steal from each other.”

Was this a content deal gone sour in the midterm or a real theft?

it really doesn't get into details - thing is - that if it is content that is stolen, image the poor webmasters now loading up Guerilla's content with free stuff only to find they may be liable?

there are alot of questions, and only speculation on it

I just spoke with tucker on icq regarding this matter - the idea is actually simple = no he is not hurting for money, but is getting annoyed at how far the line keeps getting pushed - he finally decided to push back. (NOTE: that is my illustration not his as to why he is doing this).

what he did comment on (and I don't know if this was privileged or not info) that guerilla were acting civil about this and not ignoring the situation

Boy o boy… misunderstandings...hehe

OK in no particular order;
- Tucker is NOT going after everyone.
- Falcon Foto is not having money problems. (you can’t really file a slew of Federal Lawsuits with no money).
- I personally make an effort to talk to anyone who Falcon has identified prior to filing and only file as a last resort.
- You can see that I don’t post that often but have been a member for a while.

McKidd - I have known The Legacy for years and was chatting with him offline because not everything, despite what some think, is for public consumption on a board. His analysis though it dead spot on. I am tired of people using content without permission, outside the scope of a license or from straight theft. We ALL lose money as a result of it.

Piracy plaques our industry both on and offline and we (Falcon) are in a position to help put a dent in it. We are in all facets of the adult business so we see it on all fronts; we also get hit on all fronts. I spoke about this on the FSC Piracy panel at AEE in Las Vegas last week.

I have been very busy have not had a chance to be on all the boards but in this case, I hope to reach a resolution.

Bottom line is that I don’t like fighting companies in our business but if left with no resolve, I will defend what is rightfully ours as it is our right to do so.

Last note, watch my TV Show on Sunday nights on VH1 “Shooting Sizemore”, we need all the eyeballs we can get.

Lawsuits are never fun for anyone. Thanks for dropping in and shedding light on some things, Tucker. Long time no see.

I remember meeting Gail and Falcon Foto for the first time way back in 1999 at an Adultdex.

well I find it difficult to imagine that Tucker would go through all the trouble of researching his facts out only to miss a 'rogue designer' - his legal team would have found that out waaaaay before they served guerilla on the show floor don't you think?

Guerrilla used the "rogue designer" line in a previous incident..(2004)

Not sure how you could be in biz since 2002 (or before) and not know who Tucker is.
