wow, according to their site, they're even going after educational institutions.

man, seriously, if they get away with this, they're going to be making billions.

i mean, if they want to be taken seriously, they need to take down aol, microsoft, nbc, abc, espn, etc etc.

and think about this. if they claim they aren't going to run out of money, think of the companies like msft, aol, etc. $35 million, especially divided amoun all those companies, is a drop in the bucket. if they banded together they could force these guys in the poor house from litigation alone. damn.

and all the fortune 500 companies? come on, these guys need to band together :(

It's starting to sound a bit like a pissing contest now.

Anyone who goes to court against Acacia on this should indeed raise the point that they should be targeting the much larger markets who infringe on their patent(s).
Our business strategy is not to pursue manufacturers of products that are given away for free or sold at very low margins. Your business strategy will probably not hold up in court. What's more, even those who give it away for free do so with a long term profit in mind. The potential variables here boggle the mind.

If the file consists of audio/video content, the transmission and receipt of the file is probably covered by our patents.

Friggin guys.... don't know nothing from nothing. One of these day's they'll figure out that everything sent over the net is digital... it's all electrical signals... and then they'll amend this to say "if it's electrical, it's PROBABLY covered by our patents."

They don't have a clue what the technology is themselves... they just know... "hey, it's video? is it? Moving stuff? Do you send it? Yeah, that's our patent.. I think, maybe... I'm not sure, I'll ask someone"

Idiots.

With apologies to Winston...

I have, myself, full confidence that if all do their duty, if nothing is neglected, and if the best arrangements are made, as they are being made, we shall prove ourselves once again able to defend our Internet, to ride out the storm of stupidy, and to outlive the menace of tyranny, if necessary for years, if necessary alone. At any rate, that is what we are going to try to do. Even though large tracts of Internet and many old and famous Sites have fallen or may fall into the grip of the Anti-Technologists and all the odious apparatus of Luddite rule, we shall not flag or fail. We shall go on to the end, we shall fight in the Congress, we shall fight on the courts and on TV, we shall fight with growing confidence and growing strength in the ether, we shall defend our Internet, whatever the cost may be, we shall fight on the patents, we shall fight on the obscenity charges, we shall fight with the card associations and the censors, we shall fight for the public opinion; we shall never surrender, and even if, which I do not for a moment believe, this Internet or a large part of it were subjugated and bankrupt, then the Internet beyond the seas, armed and guarded by the multitude of nations and cultures, would carry on the struggle, until, in God's good time, the New World, with all its power and might, steps forth to the rescue and the liberation of the old.

Seems like the rules for adult sites that give something away for free are a lot different than sites in the mainstream that give something away for free or "with very low margins". What a complete load of bullshit!

Is Berman supposed to be some kind of PR person?
I doesn't look like it to me.
